Divorce Basics: Getting Started in Kentucky

Filing for Divorce in Kentucky
Kentucky is a no-fault divorce state, which means you can file based on irreconcilable differences. This basically means that neither spouse has to prove wrongdoing for the divorce to proceed.
Residency Requirements
Before filing, you or your spouse must meet Kentucky’s residency requirement. Typically, one of you must have been a resident of the state for at least 180 days before you can file the divorce paperwork.
Filing a Petition
The document that officially starts the divorce process is called a Petition. According to KRS 403.150, the Petition needs to include key information like:
- Names of both parties
- Date of the marriage
- Details about any minor children involved
Once your Petition is prepared, you’ll need to sign it and file it with the appropriate court. In Kentucky, most documents—including the Petition—need to be filed electronically. There are also several standard forms that must be submitted along with your Petition.
